1. Acceptance of Terms

By accessing or using SearchFundMarket (“the Platform”), published by Mottalib Radif, you agree to be bound by these Terms of Service. If you do not agree, you may not use the Platform. These terms apply to all users, including searchers, investors, sellers, and visitors.

2. Description of Service

SearchFundMarket is an online marketplace that connects search fund entrepreneurs, investors, and business sellers. We provide a platform for listing businesses for sale, discovering acquisition opportunities, and facilitating introductions between parties. We do not act as a broker, advisor, or intermediary in any transaction. All negotiations, due diligence, and transactions are conducted directly between the parties involved.

3. Account Registration

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
• You must be at least 18 years old to create an account.
• One person may not maintain multiple accounts without prior approval.
• You must notify us immediately of any unauthorized use of your account or any other breach of security.

4. User Conduct

You agree not to:

• Post false, misleading, or fraudulent information about a business or your identity.
• Use the Platform for any unlawful purpose.
• Harass, abuse, or harm other users through the messaging system.
• Scrape, crawl, or use automated means to access the Platform without permission.
• Attempt to gain unauthorised access to other accounts or Platform systems.
• Upload or transmit viruses, malicious code, or any material that could damage or impair the Platform.
• Use the Platform to send unsolicited commercial communications (spam).

5. Listings and Content

• Sellers are solely responsible for the accuracy of information in their listings, including financial data, descriptions, and representations.
• SearchFundMarket does not verify, endorse, or guarantee the accuracy of any listing information, including financial data.
• We reserve the right to remove any listing or content that violates these Terms or is deemed inappropriate, at our sole discretion.
• By posting content on the Platform, you grant us a non-exclusive, worldwide, royalty-free licence to display it in connection with the service for as long as the content remains on the Platform.

6. No Financial or Legal Advice

SearchFundMarket does not provide financial, legal, tax, or investment advice. All information on the Platform is for informational purposes only. Listing data, valuations, and financial metrics should be independently verified. You should consult qualified professionals (including lawyers, accountants, and financial advisors) before making any acquisition or investment decision. The Platform does not guarantee the success of any transaction facilitated through the service.

7. Privacy and Data Protection

Your use of the Platform is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data in compliance with the GDPR and other applicable privacy laws.

8. Cookies

The Platform uses essential cookies required for authentication and functionality, and optional analytics cookies (Google Analytics 4) loaded only after your explicit consent via the cookie consent banner. We do not use advertising or tracking cookies. User preferences may be stored in your browser’s localStorage, which is not a cookie and is never transmitted to our servers.

9. Intellectual Property

All content, branding, design, code, and technology on the Platform are owned by Mottalib Radif or its licensors and are protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Platform without prior written permission. Brief quotations for informational purposes are permitted provided the source is credited.

10. GDPR Rights (EU Users)

Under the GDPR, EU users have the right to access, rectify, erase, restrict processing, data portability, object to processing, and withdraw consent at any time. 11. Limitation of Liability

To the fullest extent permitted by law, SearchFundMarket shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to losses resulting from transactions initiated through the Platform. The Platform is provided on an “as is” and “as available” basis without warranties of any kind, express or implied.

The publisher is not responsible for data loss, service interruptions, or damages to user equipment resulting from the use of the Platform.

12. Termination

We may suspend or terminate your account at any time if you violate these Terms or engage in conduct that is harmful to other users or the Platform. You may delete your account at any time by contacting us. Upon termination, your right to use the Platform ceases immediately, and your personal data will be handled in accordance with our Privacy Policy.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of France. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Paris, France, after any attempt at amicable resolution. The potential invalidity of any clause shall not affect the remaining provisions.

14. Changes to These Terms

We may update these Terms from time to time. Changes will be effective when posted on this page with an updated revision date. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.
